YOUR CONTINUED USE OF TRIDENT HOLIDAY HOMES WEBSITES FOLLOWING THE POSTING OF CHANGES TO THIS PRIVACY POLICY WILL MEAN THAT YOU ACCEPT THOSE CHANGES.

1. Who is Responsible for Managing My Information?

Trident Holiday Homes is owned and maintained by T D Holidays Ltd. (“we”, “us”, or “our”). This Privacy Policy describes how we collect, use, and process your personal information.

We are the Data Controller responsible for the collection and proper management of any personal information you submit to us. We are committed to keeping your personal details secure and using the information you provide consistently with applicable privacy and data protection laws, including the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Data Protection Act 2018 (Ireland), and the terms of this Privacy Policy.

2. What Information Do We Collect and What Is Our Lawful Basis for Doing So?

We collect various types of information depending on your interaction with our services. We only collect information that is necessary for the purposes for which it is collected, and we process it based on specific lawful bases as required by GDPR.

  • If you choose to make a booking through us:

    • Information Collected: We collect details that you provide in relation to that booking. This is likely to include your name, contact details (e.g., email address, phone number, postal address), payment details, information about people travelling with you, information about your booking (e.g., dates, property details), and any additional information we may need to help meet your specific travel requirements (e.g., accessibility needs).

    • Lawful Basis for Processing: The processing of this information is necessary for the performance of a contract (your holiday booking) to which you are a party. For any special categories of personal data (e.g., health information for accessibility needs), we rely on your explicit consent and the necessity for reasons of substantial public interest (e.g., health and social care if applicable, or your explicit consent for us to provide services tailored to your needs).

  • If you choose to let your holiday property with us:

    • Information Collected: We will collect details such as your name, contact details, bank account details, and details regarding the accommodation you wish to let.

    • Lawful Basis for Processing:

This processing is necessary for the performance of a contract (the letting agreement) to which you are a party.

Additionally, as an existing property owner, we have a legitimate interest in sending you correspondence, operational updates, and seasonal information relevant to your letting agreement and our services as a property manager. This may include communications sent via email (including newsletters distributed through Mailchimp), phone calls, or SMS. You will always have the right to object to these communications.

  • Website Usage Information:

    • Information Collected: We also collect website usage information. We do this using “cookies” and similar technologies.

    • Lawful Basis for Processing: For strictly necessary cookies, the lawful basis is our legitimate interest in operating our website. For all other types of cookies (e.g., analytics, marketing), we rely on your consent, which you provide via our cookie consent banner. For further information about cookies and how we use them, please see our separate Cookies Policy.

  • For Communication and Marketing (across various channels):

    • Information Collected: Your name, email address, phone number, social media handle, and any other personal details you provide to us when you subscribe to our marketing communications or interact with us on communication platforms.

    • Lawful Basis for Processing:
      • We process this information based on your explicit consent for direct marketing communications (e.g., when you sign up for our newsletter).

      • In certain circumstances, where you are an existing customer and we obtained your contact details in the context of a sale, we may send you marketing communications about our own similar products and services based on our legitimate interest as permitted by Regulation 13(11) of the ePrivacy Regulations. In such cases, we ensure that you are given a clear opportunity to opt-out at the time of data collection and are given an easy opt-out in every message.

  • Social Media and Messaging Platform Interactions:

    • Information Collected: When you interact with us on our official social media pages (e.g., by sending us a direct message, commenting on our posts, or tagging us) or via messaging apps like WhatsApp, we may collect information such as your social media handle, the content of your message or comment, and any personal information you choose to share with us through these channels. Please note that social media and messaging platforms may also collect their own data about your interactions with our pages.

    • Lawful Basis for Processing: We process this information based on our legitimate interest in engaging with our customers and the public, responding to inquiries, and promoting our services. If your interaction leads to a booking or formal request for services, the processing will shift to being necessary for the performance of a contract or to take steps at your request prior to entering into a contract. For any specific marketing activities conducted on social media or messaging platforms that involve processing your personal data, we will rely on your consent where required, or legitimate interest in the context of existing customer relationships for similar products/services, as outlined above.

3. How Do We Use Your Information?

The information you provide may be used in a number of ways, based on the lawful bases identified above, for example:

  • To complete your booking (if you are booking a holiday) and manage all aspects of your reservation.
  • To advertise your holiday accommodation, transfer payments due to you, and to provide related support services (if you are letting your holiday accommodation through us).
  • For statistical purposes when we evaluate and improve our range of services.
  • To personalise repeat visits to our websites and enhance your user experience.
  • To send you information about our own products, services, and special offers we think may be of interest to you, via phone calls, SMS, email, social media, or WhatsApp, where you have provided your consent or where we have a legitimate interest as an existing customer.
  • To manage customer service queries and provide support across all our communication channels, including phone, email, social media, and WhatsApp.
  • To help us to provide details or information you may have requested.
  • To engage with the public and respond to comments, messages, and inquiries on social media and messaging platforms.

4. Who Will You Share My Information With?

In order to provide you with the products and services that we offer, we may share your information with certain third parties. We only share the minimum necessary information required for these purposes and ensure that appropriate safeguards are in place.

  • Service Providers:

    • Individuals who may be renting accommodation from you (if you are a holiday accommodation owner) – limited to necessary contact details for booking purposes.
    • Credit/debit card processing companies – for payment processing.
    • Overseas-based letting agencies when you book a rental property outside of the Republic of Ireland.
    • Insurance Company/Agency where a Damage Protection & Cancellation policy is purchased.
    • Mailchimp: We use Mailchimp, an email and marketing automation platform, to manage our mailing lists, send email newsletters, and distribute marketing communications. Your email address and, where applicable, your name, will be shared with Mailchimp for this purpose. Mailchimp acts as our Data Processor. We have a Data Processing Addendum (DPA) in place with Mailchimp to ensure they process your data in compliance with GDPR. You can review Mailchimp’s privacy policy here.
    • Manychat: For automated communications, particularly through social media messaging platforms like Facebook Messenger or Instagram Direct, we may use Manychat. Your social media handle and interactions within these chat flows may be processed by Manychat. Manychat acts as our Data Processor, and we ensure appropriate data processing agreements are in place.
    • SMS Distribution Companies: We use third-party service providers to facilitate the distribution of messages via SMS (Short Message Service) for marketing and transactional purposes. Your phone number will be shared with these providers for message delivery. These providers also act as Data Processors, and we ensure appropriate data processing agreements are in place.
    • Social Media and Messaging Platforms (e.g., Facebook, Instagram, X/Twitter, WhatsApp): When you interact with us on our official social media pages or via WhatsApp Business, the respective platform itself processes your data according to its own privacy policy. We encourage you to review the privacy policies of the social media and messaging platforms you use to understand their data practices. For any personal data you share directly with us via these platforms that we then process for our purposes, we act as a Data Controller, and the platform may act as a joint controller or processor, depending on the specific activity.

  • Other Third Parties:

    • Where legally required or permitted, we may share your information with law enforcement, regulatory bodies, or other governmental authorities.

    • In the event of a merger, acquisition, or sale of all or a portion of our assets, your personal information may be transferred to the acquiring entity.

5. How Do You Manage My Information, Including International Transfers?

We may from time to time appoint third-party service providers to help us manage efficient systems within the business. Some of these systems may, for operational reasons, be located in countries outside the European Economic Area (EEA).

When we transfer your information to service providers located outside the EEA, we ensure that adequate levels of protection are in place to protect the integrity and security of any information being processed and compliance with applicable privacy laws. This may include reliance on:

  • Adequacy Decisions: Where the European Commission has determined that a country offers an adequate level of data protection.

  • Standard Contractual Clauses (SCCs): We implement European Commission-approved Standard Contractual Clauses with our service providers to ensure appropriate safeguards are in place for international data transfers.

  • Your explicit consent for specific transfers, where appropriate.

6. When Can We Contact You in the Future?

We would like to send you information about our own products and services, as well as those of selected third parties, that we believe may be of interest to you. We may do this by phone (calls or SMS), email, social media messaging, or WhatsApp.

  • Marketing Based on Consent: We will send you marketing communications via phone (calls or SMS), email, social media, or WhatsApp where you have provided your explicit consent to receive them. We ensure that our consent mechanisms are clear, specific, and involve a clear affirmative action from you (e.g., an unchecked box that you must tick).

  • Marketing to Existing Customers (Soft Opt-in): If you are an existing customer and we obtained your contact details in the context of a sale of our products or services, we may send you marketing communications about our similar products and services based on our legitimate interest, provided that:
    • We gave you a clear and distinct opportunity to object to (opt-out of) such marketing at the time your contact details were collected.
    • Every subsequent marketing message includes a clear and easy way for you to opt-out of receiving further communications.
    • Such communications are sent within a reasonable timeframe (e.g., within 12 months of your last purchase or interaction with our marketing).

  • Withdrawal of Consent / Opt-Out: You have the right to withdraw your consent for direct marketing or object to processing based on legitimate interest at any time. 7. How Long Will We Hold Your Information For?

We have a system of retention periods in place to ensure that your information is only stored whilst it is required for the relevant purposes for which it was collected or to meet legal, accounting, or reporting requirements. When your information is no longer required, we will ensure it is securely deleted or anonymised.

8. Recommend Our Services to Others

We may from time to time ask you if you would like to tell us about a friend or family member who you think may be interested in our products and services. In this case, we will ask you for your friend’s name and contact details.

We will then send your friend a one-time communication to see whether our products and services may be of interest to them, clearly stating that you referred them. We do not access or store their details for any purpose other than to send this initial communication and track the referral, unless they subsequently provide their own consent for marketing.

  • Rights in Relation to Automated Decision-Making and Profiling: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, unless certain exceptions apply. We do not currently engage in such automated decision-making.

To exercise any of these rights, please contact us using the details in Section 13. We will respond to your request within one month, which may be extended by two further months if the request is complex or numerous.
